Deshmukh govt directive not statutory, `80% Locals In Maharashtra Industry' Is 60s Resolution

The Maharashtra government's directive to industry, to give priority to locals for 80% job's is more of an exercise in political posturing than a genuine gesture to the Marathi community, officials and politicians associated with the move believe.

The government resolution asks industry to fill up 80% jobs with locals and not necessarily Marathi population, officials point out. Second, the resolution is not statutory on the industrial units even though the government claims to have put in place a two-tier administrative machinery to monitor implementation of the policy.

Without legal sanctity or a clear message to the industry, the move is apparently a response to the campaign launched by Maharashtra Navnirman Sena and Shiv Sena, sources said.

"This is merely a government resolution which does not have legal backing. There is no reason why the industry should be unduly worried about it since it is not a legislation or even a notification that could be legally mandatory," said a senior bureaucrat who did not wish to be named. The official conceded that this time the state has put in place an elaborate machinery to monitor implementation of the policy.

"But that's the only difference. Otherwise the policy has been there since the late 60s. The resolution that has been issued now is merely a revival of similar resolutions passed in 1968, 1970, 1973, and as recent as 2007. This decision has never been enforced simply because there is no legal procedure to achieve it," the official said.

Another industry department official, however, insisted that the resolution is indeed binding in nature in the sense industrial units have to submit affidavit to the government machinery detailing their plans for recruitment.

"Proprietors will have to submit these affidavits to the committee under district collector. The development commissioner (industries) will be in possession of these affidavits which will detail the recruitment plan. In case the policy is not adhered to by some units, the development commissioner can take action," this official said. Action could be in the form of withdrawal of incentives given to the unit or show cause notice by the development commissioner as to why the policy is not being followed.

But the procedure to monitor implementation is typically bureaucratic and largely without teeth, a section of government officials feels. "A committee under the collector is supposed to meet every three months. The statelevel committee under development commissioner is to meet thrice a year. It will take a long time for directives or actions from the top to trickle down," a source said.

A Congress politician with a thorough knowledge of Maharashtra's industrial profile offered a different perspective: The state is already following this policy in several sectors. "A large section of industrial employment in Mumbai, Pune, Aurangabad, and Nashik comprised people who are domiciled in Maharashtra for almost two decades. There are Maharashtrians who are by definition locals. The policy is only against recruiting more than 20% people who are not domiciled in the state. That's is happening even now," the Congress functionary said.
